These Terms of Service set out the conditions under which Dsc Property Services Ltd. provides land services from its East Preston yard and operates the website at https://www.dscproperty.surf. They apply to every instruction, every work order and every handover unless a separate written agreement signed by the company says otherwise.
Please read the terms before sending an instruction. If any part is unclear, telephone the yard office on +14325525168 and we will explain it in everyday language before work begins.
1. Agreement to these terms
By instructing Dsc Property Services Ltd., by accepting a written scope or by using this website, the client agrees to these terms. The agreement is formed when the yard office confirms a work order in writing, and it covers the services listed in that work order and nothing else.
If the client is acting for a company or a trust, the person who sends the instruction confirms that they have authority to bind that company or trust. If that authority later turns out to be absent, the person who sent the instruction remains responsible for the fees that have been incurred.
Where a signed contract conflicts with these terms, the signed contract prevails. In all other cases these terms are the complete statement of the conditions of service.
2. Company identity and details
The services described in these terms are provided by Dsc Property Services Ltd., a company working from 17 Lower Partridge River Rd, East Preston - B2Z 1G7, Canada (CA). The company can be reached by email at message@dscproperty.surf or by telephone on +14325525168 during business hours.
The yard office handles enquiries on Monday to Thursday from 08:30 to 17:00 and on Friday from 08:30 to 15:30. Saturday appointments are available on request and Sunday is closed. Notices sent outside these hours are recorded when received and answered on the next working day.
The website at https://www.dscproperty.surf is operated by the developer known as DSC Property on behalf of Dsc Property Services Ltd. These terms apply to the website as well as to the land services.
3. Scope of services
The company provides six land services: survey note bays, title check runs, work order desks, fence line windows, drainage review rounds and handover sittings. Each service is described on the services page and in the written work order, and the description in the work order controls the scope of the job.
The services are record based. We read records, walk a parcel, take notes and prepare written reports. We do not provide legal advice, we do not act as a lender, and we do not certify title. Where a matter requires a lawyer, a licensed surveyor or a qualified engineer, we say so and we refer the client to an appropriate professional.
Any statement in a report describes conditions observed on the date of the visit. A report is not a warranty that a boundary, a fence or a drainage route will remain unchanged after that date.
4. Instructions and work orders
No work begins until the yard office has opened a work order. An instruction may arrive by telephone, by email or through the contact form, but it becomes a work order only when the written scope has been issued and confirmed.
Each work order carries a reference number, a named owner, a yard date and a list of deliverables. The reference number should be quoted in every later message about the job. Amendments are recorded against the original order rather than opened as new jobs, so the full history of an instruction remains in one place.
A client may ask to change a work order at any time before the field visit. If the change alters the time or the cost of the job, the yard office issues a written amendment and the client confirms it before the revised work proceeds.
5. Client responsibilities
The client agrees to give accurate information about the parcel, including the legal description, the civic address and any known dispute about a boundary. A report can only be as reliable as the instruction behind it, and a mistaken parcel number can send an officer to the wrong gate.
The client agrees to respond to requests for clarification within a reasonable period. If an instruction cannot be completed because a necessary detail is missing, the yard may pause the job and note the pause in the file. Time spent waiting is not counted against the schedule.
The client agrees not to ask the company to record a statement that is known to be false, and not to alter a report after it has been signed. A report may be quoted, but it must be quoted in full or clearly marked as an extract.
6. Site access and safety
Where a field visit is required, the client agrees to arrange lawful access to the parcel for the date agreed in the work order. Where access depends on a neighbour or a tenant, the client is responsible for obtaining that permission before the officer arrives.
Officers follow safety rules at every visit. They will not enter a locked building without permission, will not climb an unsafe structure and will not walk a site in hazardous conditions. If a visit cannot proceed safely, the officer records the reason and the yard office contacts the client to reschedule.
The client should tell us in advance about dogs, livestock, machinery, chemicals or any other hazard on the parcel. This information is recorded in the work order so that the officer can prepare before leaving the yard.
7. Fees and payment
Fees are quoted in the work order before the job begins. A quote may be a fixed fee for a defined scope or a stated hourly rate for work that cannot be measured in advance. Where a job is quoted at an hourly rate, the yard office estimates the likely total and explains what would cause the estimate to change.
Invoices are issued on completion of the work or at the end of a stated billing period. Unless the work order says otherwise, payment is due within thirty days of the invoice date. The invoice states the accepted payment methods and the reference that should be quoted with the payment.
Late payment may attract an interest charge calculated at a rate stated on the invoice. Where an account remains unpaid, the company may pause new work and withhold finished deliverables until the account is settled. We do not add hidden charges and we do not invoice for a service the client did not receive.
8. Scheduling and changes
Yard dates are agreed with the client and recorded in the work order. Most title check runs are scheduled within five working days of a confirmed instruction, and field visits are timed to suit daylight and weather.
A date may need to move because of rain, a blocked access road or an urgent call on another parcel. When this happens the yard office contacts the client as soon as the change is known and offers the next available date. No fee is charged for a change caused by the company.
A client who moves a confirmed date with less than one working day of notice may be charged for the officer time already committed. The charge, where it applies, is stated in the work order so that it is never a surprise.
9. Deliverables and reports
Each service produces a defined deliverable. A survey note produces a filed note with a sketch and a reading list. A title check run produces a dated three-part report. A fence line window produces a sequenced record with photographs. A drainage review round produces a short note and a sketch. A handover sitting produces a signed pack.
A draft is offered to the client before the report is sealed. The client may point out a factual correction, and the officer will check the point on site if the correction depends on a condition on the ground. A change of opinion is not the same as a correction, and a disagreement about interpretation is recorded rather than removed.
Reports are delivered in the format stated in the work order, usually an electronic copy with a printed set available on request. We confirm the recipient of each copy and record the delivery date in the file.
10. Handover sitting and closure
Every file ends with a handover sitting unless the client and the company agree in writing to close the file without one. At the sitting we walk the full pack, answer questions and sign the register. The signature confirms that the client has received the pack.
Signing the register is not a statement that the client agrees with every conclusion in the report. It confirms receipt and it records the date on which the file was closed. Any objection raised at the sitting is written into the register and becomes part of the file.
Requests received after the handover stay connected to the same file reference. Where a request requires fresh field work, a new work order is opened and the earlier pack is attached to it for reference.
11. Ownership of records
The client owns the copies of the reports delivered for the parcels in the work order. The company keeps the working files, including sketches, drafts and field notes, and uses them to answer later questions and to maintain the consistency of the record.
The company retains the right to refer to a parcel file after a job is closed, because a later title check or fence line window on the same ground depends on the earlier notes. Any such reference is internal and is covered by the confidentiality section below.
If the client asks for the working files to be destroyed, we will remove the copies where the law allows and confirm the destruction in writing. We will explain if a record must be retained for a legal or accounting reason.
12. Confidentiality
We treat every client file as confidential. Information about a parcel, a purchase, a boundary dispute or a drainage problem is shared only with the people who need it to deliver the service or to meet a legal requirement.
Officers and staff are bound by this duty from the first day of employment and after they leave the yard. Access to a working area is limited to those who are responsible for it, and a file is not left open where a visitor could read it.
The client agrees to keep the contents of a confidential report confidential as well, except where disclosure is required by law or is necessary to pursue a professional or legal process connected with the parcel.
13. Limitation of liability
The company prepares its reports with reasonable care and skill. Even so, a report describes conditions on a single date, and the company cannot be responsible for a change caused by weather, construction or a later decision by an owner or a public authority.
To the extent permitted by law, the total liability of Dsc Property Services Ltd. for any claim connected with a work order is limited to the fee paid for the service that gave rise to the claim. The company is not liable for lost profit, lost opportunity or indirect loss of any kind.
Nothing in these terms removes a liability that cannot be limited by law, including liability for fraud or for a deliberate failure to perform the service. If a court finds part of this section unenforceable, the rest of the terms remain in force.
14. Third party information
A report may rely on a registry printout, a plan copy, a municipal record or a statement supplied by the client. We identify those sources in the file, but we do not guarantee the accuracy of a document that we have not produced.
Where a third party record conflicts with a field observation, we report the conflict and explain which source was used for each conclusion. The client can then decide whether to ask the holder of the third party record to correct it.
A neighbour who shares information during a visit is not a client of the company. Their statement is recorded as part of the observation, but the company does not owe a duty of care to that neighbour in relation to the report.
15. Cancellation and termination
The client may cancel a work order at any time before the field visit by writing to the yard office. Where the officer has already travelled to the site, the client is charged for the time and travel incurred up to the point of cancellation.
The company may decline or terminate a work order where the instruction is unlawful, where a site cannot be accessed safely, where the client has failed to pay an overdue invoice, or where a conflict of interest has arisen. In that case any fee not yet earned is refunded.
Termination does not affect a clause that is intended to survive it, including confidentiality, limitation of liability and governing law. A cancelled file is retained in accordance with the privacy policy.
16. Use of this website
The website is provided for information about the company and its services. It is offered as it stands, and we do not warrant that every page will always be available or free of error. We correct a fault as soon as we become aware of it.
A visitor agrees not to interfere with the operation of the site, not to attempt to gain access to a restricted area and not to use automated tools to copy large parts of it. The contact form is provided for genuine enquiries and must not be used to send bulk or unsolicited commercial messages.
Nothing on this website constitutes legal advice or a binding offer. A service is only engaged when a work order has been confirmed in writing.
17. Intellectual property
The text, layout, illustrations and code on this website belong to Dsc Property Services Ltd. or are used with permission. A visitor may view the pages and print a copy for personal reference, but may not republish the content for commercial gain without written permission.
The report templates, the note bay numbering system and the work order method are owned by the company and are not transferred to a client by the delivery of a report. The client receives the findings, not the method.
The company name and the website address may be quoted fairly when describing the company, for example in a professional correspondence or a business directory, provided the quotation is accurate and does not suggest an endorsement that does not exist.
18. Governing law and disputes
These terms are governed by the laws of Canada and of the province in which the East Preston yard is located. The courts of that province have jurisdiction over any dispute that cannot be resolved by discussion.
Before a formal step is taken, the parties agree to attempt a good faith discussion within thirty days of a written complaint. The yard manager will meet the client, review the file and propose a practical resolution. Many disagreements turn out to be a misunderstanding of a note, and a short meeting is often enough to settle them.
If a discussion does not resolve the matter, either party may refer it to mediation before starting a court action. The cost of mediation is shared equally unless the mediator decides otherwise.
19. Events beyond our control
The company is not responsible for a delay or a failure caused by an event outside its reasonable control. Such an event includes severe weather, flooding, a road closure, a power failure, a public health restriction or an act of a public authority.
When such an event occurs, the yard office contacts the client as soon as it can and proposes a revised date. Fees already earned for work completed before the event remain payable, and no penalty is charged for the delay itself.
If an event continues for more than sixty days, either party may end the work order. In that case the company returns any fee paid for work that has not been started.
20. Amendments to these terms
We review these terms when our services change or when the law requires an update. The effective date at the top of the page shows the current version. The latest version always applies to a new work order.
For a work order already in progress, the terms in force when the order was confirmed continue to apply, unless the client agrees in writing to a later version. A change to the terms does not reduce an obligation the company has already accepted.
If any part of these terms is found to be invalid, the remaining parts continue in force. A failure to enforce a term on one occasion is not a waiver of that term on a later occasion.
